๐ฒ๐พ Valuing your Indian property from Malaysia
MM2H applicants and long settled families both need clean Indian documentation.
Where Malaysia rules reach your Indian property
Source of funds
If your fixed deposit is funded by an Indian property sale, the trail has to hold up.
Where the Indian valuation comes up
Two situations dominate for Indian families in Malaysia. Residency applications that ask you to evidence assets and the source of your funds, and inherited property back home that eventually has to be sold or divided.
Source of funds, traced properly
Where a residency scheme asks you to show the origin of a fixed deposit or an investment, and that money came from selling Indian property, the trail has to hold up. That means the sale documentation, the tax position on the Indian side, and a valuation that substantiates what the asset was worth. An unevidenced assertion about a property sale is exactly the kind of thing that stalls an application.
Selling from Malaysia
Your buyer deducts Indian tax at source on the whole sale value rather than your gain. The certificate that reduces it must be obtained before completion. Afterwards it becomes a refund claim.
Where the property was bought before April 2001, or inherited from somebody who bought before then, establishing the 1 April 2001 value is usually the largest single saving available.
Getting the proceeds out
Repatriation runs through your non resident ordinary account within the annual limit, and requires certification from a chartered accountant, which in turn requires a properly computed gain.
Inherited shares in family property
Many Malaysian Indian families hold a fraction of an ancestral holding in Tamil Nadu, Kerala or Andhra Pradesh. Valuing an undivided share is not simply the total divided by your fraction, because access, shape and which portion you would receive on partition all matter. The report addresses that rather than doing arithmetic.
