Where Singapore rules reach your Indian property

01

HDB eligibility

Applicants must not own or have an interest in any local or overseas private residential property, with a waiting period after disposal. If you are buying an HDB flat, your Indian flat matters.

02

Accredited investor status

Net personal assets tests count foreign real estate, subject to the cap on the value of a primary residence.

03

India side still applies

No tax here does not mean no tax there. The Indian capital gains and TDS position is unchanged.

One property, sometimes two valuations. Your filing in Singapore often needs the value at one date, and your Indian filing needs it at another. We prepare both together so the two never contradict each other.

No capital gains tax there, full compliance here

Singapore does not tax capital gains, so selling your Indian property creates no Singapore charge on the gain itself. That makes people relax, and then the Indian side catches them.

The deduction that leaves before you do

Your buyer must deduct Indian tax at source on the whole sale value rather than on your profit. A lower deduction certificate reduces that to your actual gain, but it has to be in place before completion. Applying afterwards turns it into a refund claim measured in months.

The application needs your cost evidenced. For property bought before April 2001, or inherited from somebody who bought before then, that means a 1 April 2001 valuation.

Getting the money to Singapore

Proceeds move through your non resident ordinary account within the annual limit, and your bank requires certification from a chartered accountant before releasing anything. The certificate depends on the gain being computed correctly, which loops back to the valuation.

Employment pass and permanent residence applications

Where a scheme asks you to evidence assets, the Indian property needs a figure somebody can verify. A report carrying a registration number that can be checked is worth considerably more than a broker's letter.

Succession across two jurisdictions

A Singapore will does not automatically deal with Indian immovable property in the way families expect. Where the estate includes an Indian flat or land, Indian succession procedure applies to that asset, and court fees are often calculated on its value.

Practicalities

Two and a half hours ahead of India, so same day turnaround is routine. Reports issue in rupees with a Singapore dollar conversion, stating the rate and its source.
