Where Kuwait rules reach your Indian property

01

Inheritance

Indian property passes under Indian succession law regardless of where you live.

02

Sale from abroad

Our engineer inspects, you never fly back.

One property, sometimes two valuations. Your filing in Kuwait often needs the value at one date, and your Indian filing needs it at another. We prepare both together so the two never contradict each other.

A large community, one set of Indian rules

Kuwait charges no personal income tax, so the Indian position is the only one that matters when you sell or inherit. The rules are the same ones applying to every non resident, and the same two mistakes recur.

Mistake one: selling before the paperwork

Your buyer must deduct Indian tax at source on the entire sale value. A lower deduction certificate reduces that to your real gain, but it cannot be applied retrospectively. Once tax has been deducted and deposited, you are into a refund claim. Start the valuation when you decide to sell, not once the agreement is drafted.

Mistake two: assuming inheritance resets the cost

It does not. You take the purchase date and the cost of the person you inherited from. That is what makes the gain long term, and it is what allows the 1 April 2001 value to be substituted where they bought before that date. Inheriting is not itself taxable in India. The question arises on sale.

Repatriation

Proceeds leave through your non resident ordinary account within the annual limit, once a chartered accountant has certified the transaction. That certificate needs the gain computed properly.

Succession for families split across countries

Indian immovable property passes under Indian succession law regardless of where you live or where a will was made. Heirs in Kuwait typically need documents attested locally, and court fees are frequently calculated on the value of the estate.

Remote by design

Our engineer visits the property, photographs it with the date and location recorded, and the report reaches you by email. Nobody flies anywhere.
